Recent technological advances have driven reforms in various areas of life. This is particularly true in the field of land transportation, where we have seen a rapid increase in the number of vehicles on the road, which has gone hand in hand with a rise in traffic accidents. Consequently, each country has enacted specific legislation regarding traffic accidents, making automobile insurance mandatory in an effort to compensate victims. In French-speaking African countries, the adoption of the CIMA treaty brought about a reform by integrating the insurance markets of these states and establishing a single insurance code. This code establishes a system favorable to victims of traffic accidents. The two legal systems differ in terms of the criteria for classifying a traffic accident and the mechanisms for compensating victims. We have observed that two criteria characterize a traffic accident: the objective criterion regarding the attribution of the traffic accident to the vehicle, and the subjective criterion regarding the beneficiaries of the compensation.
