The law that flowed from this completely destroyed the federal justice system and tarnished the reputation of the whole American justice system. - Eric Sterling, who as a young congressional aide helped draft the Anti-Drug Abuse Act of 1986
It's horrible. It's the cruelest thing I ever heard. - Larry Bird, on learning of Len Bias's death
June 17, 1986: The Boston Celtics select Len Bias - 6-foot-8, 240 pounds, two-time ACC Player of the Year, consensus first-team All-American, the greatest prospect in the draft - with the second overall pick. Red Auerbach had wanted him. Larry Bird had urged the organization to select him. He signs a $3 million Reebok deal. He meets the Boston media. He flies home to Maryland.
June 19, 1986, 6:30 a.m.: Len Bias collapses in his dormitory room at the University of Maryland. He is pronounced dead at 8:50 a.m. Cause of death: cardiac arrhythmia induced by a cocaine overdose. He is 22 years old.
He was using powder cocaine. Not crack cocaine. A false rumor spread in the press immediately after his death that he had smoked crack. By the time the medical facts were established, the political process was already in motion.
House Speaker Tip O'Neill of Massachusetts - whose Boston-area constituents were consumed with grief and anger over Bias's death - returned to Washington and called an emergency meeting of crime-related committee chairmen. An election was coming in November 1986. Drugs were front-page news. The Democrats needed to outflank the Republicans on crime.
Four months later, Congress passed the Anti-Drug Abuse Act of 1986. No committee hearings on the mandatory minimum sentencing provisions. No pharmacologists testified. No criminologists testified. No one from the Bureau of Prisons testified. No one appears to have asked whether the specific sentencing thresholds being written were rational, proportionate, or likely to achieve the stated goals.
The law established a 100-to-1 sentencing disparity between crack cocaine and powder cocaine - the same drug in different forms. Five grams of crack triggered the same mandatory minimum as 500 grams of powder. Crack cocaine was primarily used by poor Black Americans; powder cocaine was primarily used by wealthier white Americans. Black individuals comprised the vast majority of those convicted of federal crack offenses. Thousands of first-time, non-violent offenders were sentenced to a decade or more in federal prison.
Clarence Aaron - no prior criminal record, pulled over in a car containing crack cocaine - was sentenced to more than 19 years in federal prison. He was pardoned by President Clinton in 2001.
The Fair Sentencing Act of 2010 finally reduced the disparity from 100-to-1 to 18-to-1. The First Step Act of 2018 made the reform retroactive. Thousands of people serving sentences under the 100-to-1 disparity became eligible for resentencing.
Len Bias did not use crack cocaine. He had no connection to the crack trade. He was a 22-year-old basketball player who died at a party. His death was used as the emotional foundation for a law that disproportionately destroyed the lives of young Black men for three decades.
