This study analyzes the jurisprudential evolution of the European Court of Human Rights (ECtHR) on the protection of family life and children's rights between 2020 and 2025, assessing its impact on the Spanish legal system. Using a mixed methodology that combines documentary analysis of 247 ECtHR rulings, systematic review of updated doctrine and semi-structured interviews with 45 family law professionals, six critical areas are identified: the right of the child to be heard, international child abduction, foster care and adoption systems, recognition of parenthood, gender identity in minors and surrogacy. The results reveal a consolidated trend towards the evolutionary interpretation of Article 8 of the European Convention on Human Rights (ECHR), giving priority to the best interests of the child as the guiding principle. There is a 34% increase in convictions of States for violation of the right of the child to be heard, as well as a more restrictive jurisprudence in cases of international abduction. The study shows the need for legislative harmonization in Spain.
