In 1803, Chief Justice John Marshall wrote the most important sentence in American constitutional law: any law repugnant to the Constitution is null and void. He wrote it in Marbury v. Madison - the decision that established the Supreme Court's authority to strike down unconstitutional legislation - and it has been the foundational principle of American constitutional law ever since.
Two hundred and twenty years later, the federal government passes laws that violate the First Amendment. It operates surveillance programs that violate the Fourth Amendment. It seizes property without criminal convictions under civil asset forfeiture frameworks that violate the Fifth Amendment. It runs an administrative state that exercises legislative power the Constitution vested exclusively in Congress. State governments do the same. And the Supreme Court - the institution Marshall charged with enforcing the null and void principle - has spent two centuries building an elaborate architecture of avoidance: qualified immunity, sovereign immunity, rational basis review, the standing doctrine, the political question doctrine, and Chevron deference. None of these doctrines appear in the Constitution. Every one of them was invented by the courts themselves to manage the implications of Marshall's promise rather than fulfill it.
Null and Void examines how that happened - chapter by chapter, case by case, doctrine by doctrine. It traces the specific constitutional violations embedded in the laws Americans live under right now. It examines the First Amendment's disparagement clause that survived for seventy-two years before a court struck it down. The Second Amendment's protection that lower courts spent decades refusing to enforce. The Fourth Amendment's warrant requirement that the NSA's bulk surveillance programs were specifically designed to avoid. The Fifth Amendment's public use requirement that the Supreme Court eliminated in Kelo v. City of New London by substituting a deferential public purpose standard. The Tenth Amendment's reservation of powers that Wickard v. Filburn effectively erased by holding that a farmer's personal wheat consumption was interstate commerce.
This book does not traffic in conspiracy or legal theory untethered from the record. Every argument is anchored in named constitutional provisions, named Supreme Court decisions, named federal statutes, and the documented human cost of the gap between what Marshall promised and what the republic has delivered. It presents the complete honest picture - including where courts have upheld laws this book argues are unconstitutional, and what the legal arguments on both sides actually say.
Marshall's promise has not been abandoned. Every constitutional challenge that succeeds, every unconstitutional regulation struck down, every qualified immunity case that reaches the merits is that promise functioning exactly as he designed it.
