Before the Stars and Stripes became the singular emblem of American authority, there was another flag. It flew over customs houses and revenue cutters, marked the boundary between civilian commerce and military power, and communicated something precise to every vessel and institution that encountered it: the authority here is constitutional, civilian, and bounded by law.
That flag is the civil peace flag. And most Americans have never heard of it.
The civil peace flag is not a modern invention. It is not a conspiracy theory symbol or a fringe political artifact. It is a documented feature of early American governance - formally designated by Treasury Secretary Oliver Wolcott, approved by President John Adams in 1799, and required by federal law over every customhouse in the republic by 1874. It flew over the Revenue Cutter Service that Alexander Hamilton built from scratch in 1790 as a specifically civilian enforcement agency, designed to collect customs duties through constitutional civilian authority rather than military force. Its vertical stripes were chosen deliberately to distinguish it from the Stars and Stripes - to communicate, at a glance, that the authority operating under it was civilian, not martial.
Then it disappeared.
This book traces that disappearance through the Civil War's expansion of federal military authority over civilian life, the Reconstruction era's deployment of military governance in states where civilian courts remained open, the Progressive Era's consolidation of federal power, and the Coast Guard Act of 1915 that absorbed the Revenue Cutter Service and erased its civilian ensign from official use. Along the way it examines the constitutional framework that gave the flag its meaning - the Third Amendment's prohibition on military quartering in civilian homes, the Posse Comitatus Act's prohibition on using military forces to execute civilian law, and the Supreme Court's landmark decisions in Ex parte Milligan, Boumediene v. Bush, and the post-September 11 national security cases that have grappled with the limits of executive military authority over civilian life.
The book also confronts the civil peace flag's modern revival honestly. The sovereign citizen movement rediscovered the flag in the 1990s and attached it to legal theories - about admiralty jurisdiction, gold fringe conspiracies, and corporate government - that every federal court has correctly and uniformly rejected. This book examines those theories, explains precisely why they fail, and demonstrates that the flag's genuine constitutional significance does not depend on any of them.
