Preface: How to Use This Handbook
A loan signing assignment in New York sits at the intersection of notary law, mortgage-document handling, private closing instructions, information security, and unauthorized-practice restrictions. The core discipline is separation of roles. The notary decides whether the notarial act can lawfully be performed. The lender, attorney, title professional, or settlement agent answers questions within that professional's authority. The signing professional preserves documents, follows written instructions, and reports exceptions without becoming the decision-maker on legal substance.
Use the handbook in three passes. First, read Parts One through Three to understand the legal boundary and New York notarial requirements. Second, use Part Four to learn the neutral function of common mortgage documents. Third, use Parts Five and Six as the operating system for accepting, conducting, documenting, and closing an assignment. The appendices are designed for field use and may be adapted to the contracting party's forms.
