En esta edición hemos incluido, además de la explicación de los términos Incoterms, algunas casuísticas y situaciones en todos ellos, para que el usuario lector elija e incorpore en su contrato de compraventa internacional aquél que se acomoda más a sus circunstancias e intereses.
También hemos incluido un apartado nuevo, cuya finalidad es que el lector analice diversos aspectos para que la elección del término Incoterm sea la correcta.
El propósito de los Incoterms es proporcionar una interpretación INTERNACIONAL común de los diferentes términos comerciales utilizados en todos los países.
Es importante conocer bien los Incoterms para elegir el más adecuado, para ello la empresa (exportadora o importadora), debe tener claro si le interesa realizar o no el transporte principal, si quiere controlar los costes y gastos desde origen a destino, reducir los riesgos (principalmente en el transporte), o tener mayor seguridad en la cadena logística.
La elección del término Incoterm debe efectuarse según las capacidades de organización de las empresas que firman el contrato, del medio de transporte a utilizar, del nivel de servicio que se ofrece al cliente o se recibe del proveedor, de las costumbres del mercado y de las prácticas de la competencia.
Hay dos tipos de entrega:
2.Indirecta: Las mercancías se entregan a través de un intermediario, transportista o transitario. Se utiliza en los términos de los grupos F y C.
El punto de la transferencia de los riesgos (de pérdida, deterioro, daño o robo de la mercancía) del vendedor al comprador en el proceso de envío de la mercancía.
Quién realiza el despacho aduanero de exportación y/o importación, y el pago de los derechos aduaneros, impuestos y costes asociados.
Por cuenta de quien corren los gastos de transporte, seguro, aduana, carga, carga y descarga, inspección, etc.
Los Incoterms forman parte de los acuerdos y contratos comerciales y orientan a importadores, exportadores, abogados, a compañías de seguros y de transporte.

Los Incoterms no son leyes, son usos y reglas, y por ello, una versión nueva no deroga las anteriores; cuando se especifica el nombre del Incoterm hay que indicar a qué versión se refiere, la última en 2020.
