L'auteur a voulu dans ces pages énoncer et justifier les voeux formés aujourd'hui par le public éclairé relativement aux droits qu'une bonne législation doit consacrer. Leur cadre est donc celui d'un traité de droit naturel, dont l'idée dominante serait que le droit naît du devoir, mais que le juge du devoir étant la conscience individuelle, l'accomplissement n'en est exigible par voie de contrainte que dans la mesure indispensable à la conservation des droits d'autrui.
En avance sur son temps à l'égard de certaines questions sociétales, Charles Secrétan - Juriste, enseignant, théologien protestant et philosophe suisse de renom - défend par exemple l'émancipation féminine et soutient les minorités religieuses, sur la base d'une position intellectuelle visant à faire de la liberté personnelle et de la solidarité les clés de la question sociale.

L'État, quel que soit le nom qu'on donne à la chose, quelque soin qu'on prenne pour la gazer ou pour l'embellir, se trouve toujours en dernière analyse un arrangement par lequel un nombre quelconque de personnes arrive à pouvoir contraindre les autres habitants de faire ce qu'elles ordonnent et de s'abstenir de ce qu'elles défendent. Si l'on voit avec nous dans la liberté personnelle le premier des biens naturels, en tant qu'elle est la condition indispensable et suffisante du seul bien réel, positif, absolu: la bonté, l'excellence morale, le bien, tout court; on confessera que l'État est un pis-aller, un mal nécessaire, ou pour mieux dire un très grand bien, certainement; puisque nous tremblons tous à l'idée de passer un quart d'heure sans sa protection dans le voisinage de nos frères; mais un bien relatif, dont un mal est l'origine; puisque ce qui se fait sous l'empire de la contrainte ne saurait participer au bien positif, dont le champ se trouve ainsi diminué.
