La filosofÃa polÃtica y social de la modernidad ha sido entendida, tradicionalmente, como una visión individualista donde la sociedad se concibe como un agregado de agentes autónomos. Esta perspectiva deriva, a su vez, en teorÃas sobre la legitimidad del poder, las instituciones y la restricción de la libertad individual.
Este libro propone una lectura alternativa desde las teorÃas del reconocimiento, corrientes filosóficas que buscan explicar cómo la individualidad -en su sentido más pleno- es un logro histórico construido a partir de relaciones intersubjetivas. Lejos de reducirse a un enfoque puramente normativo, estas teorÃas se apoyan en bases empÃricas que muestran cómo los compromisos, obligaciones y cursos de acción posibles para cada persona dependen de vÃnculos de reconocimiento mutuo.
Los ensayos que conforman este volumen examinan esta perspectiva para reinterpretar categorÃas jurÃdicas fundamentales, como la autoridad, la libertad de expresión, los derechos sociales, la propiedad, los impuestos, la identidad, la argumentación y el consentimiento. Desde esta mirada, las instituciones pueden entenderse de manera más transparente y coherente que desde un individualismo estricto, permitiendo resolver conflictos que este último no logra abordar.
El resultado es una propuesta que integra filosofÃa, derecho y teorÃa social, ofreciendo herramientas conceptuales para repensar las instituciones jurÃdicas en Chile y en el contexto contemporáneo. Una invitación a comprender la sociedad moderna no como un conjunto aislado de individuos, sino como una estructura de relaciones que hacen posible la libertad, la justicia y la vida en común.
