Pakistan was founded amid a profound constitutional question that continues to shape its political and legal development: what does it mean to be an Islamic Republic? Since independence, successive constitutions have affirmed that the state should enable Muslims to order their lives in accordance with the teachings of Islam while simultaneously maintaining representative government, constitutionalism, and the rule of law. Yet the practical challenge of translating this constitutional vision into legislation and public policy has remained one of the most debated issues in Pakistan's history.
This book offers the first comprehensive institutional history of the Council of Islamic Ideology, covering its evolution from its constitutional origins in the early 1960s to its contemporary role in 2026. Drawing upon national and international resources, the study provides the most detailed examination to date of the Council's mandate, performance, achievements, limitations, and future prospects.
The book challenges two dominant narratives that have long shaped discussions of the CII. The first portrays the Council as an ineffective institution whose recommendations have had little practical impact on Pakistan's legal system. The second presents it as a successful vehicle for the Islamization of law and governance. Through a careful assessment of the evidence, this study demonstrates that both views are incomplete. The Council has neither failed entirely nor achieved the comprehensive transformation envisioned by its founders.
Over more than six decades, the CII has generated an extensive body of scholarship on constitutional law, family law, criminal justice, economic regulation, Islamic finance, and public policy. It has contributed to important debates on Islamization, influenced legislative discussions, and helped sustain the constitutional commitment to aligning legislation with Islamic norms. At the same time, many of its recommendations have remained unimplemented, governments have frequently ignored its advice, and its advisory status has limited its ability to bring about lasting legal change.
The central argument of this book is that the Council's limited effectiveness cannot be explained solely by political resistance. Rather, it reflects a broader combination of institutional weaknesses, constitutional design limitations, inadequate implementation mechanisms, inconsistent state commitment, insufficient research capacity, and the absence of a coherent national strategy for legal Islamization. The study argues that the real issue is not whether the Council has succeeded or failed, but whether Pakistan has ever created the political and institutional conditions necessary for the CII to fulfill the role assigned to it under the Constitution.
More than a historical account, this work is also a study of institutional reform. It concludes by proposing a practical roadmap for strengthening the Council's research capabilities, improving parliamentary engagement, enhancing public participation, and establishing effective mechanisms for reviewing and implementing its recommendations.
