A STRAIT WAS CLAIMED IN ONE SENTENCE. THE LAW HAS NEVER MOVED THAT FAST. On August 14, 2026, speaking to a crowd on Long Island, the president said that once the war with Iran was over, he would soon declare the Strait of Hormuz a territory of the United States. Iran's government rejected the claim within a day. Neither side has anything resembling a treaty, a statute, or a vote behind it.
In The Word and the Waterway, Gerard Tod follows a mechanism two centuries older than that sentence: the American habit of declaring a territory first and finding, or failing to find, the law to back it up later. The trail runs through an 1856 statute that let any citizen claim an unclaimed island by standing on it; a doctrine, delivered to Congress in 1823, that closed an entire hemisphere to Europe with no navy able to enforce it; a disputed river that started a war in 1846; a queen deposed in 1893 whose kingdom was annexed five years later by a legislative shortcut, after the correct process failed by fourteen votes; a Panamanian revolution that arrived, conveniently, on schedule in 1903; a canal seized by three armies in 1956 and given back within a month; and a purchase of Alaska, in 1867, that needed no declaration at all because the treaty came first.
This is not a book about whether the war with Iran is justified, or who should win it. It is a book about what a declaration is actually doing, historically, in the space between the sentence that makes it and the law that would be required to make it real. Some declarations, this book finds, eventually got their law. Others never did.
The newest volume in the series turns from constitutional method to executive claim: not how a court reads the past to decide a case, but how a president's word tries to become a fact on a map. The waterway is still there. So, for now, is the word standing next to it.
This is not a book about whether the war with Iran is justified, or who should win it.
