Some Georgia communities affirmatively elected into the Property Owners' Association Act. Condominiums are covered automatically by a different statute. Everyone else has recorded covenants and very little else. Most owners have never checked which one they are in, and many boards do not know either.
It matters more than it ever has. The 2027 foreclosure reforms - the threshold, the sixty day notice, the lien timeline - amend only the Property Owners' Association Act. The Condominium Act was not touched. Two law firms have flagged the gap. Nobody has resolved it.
So a Georgia condominium owner gets the new complaint process but may not get the new foreclosure protections. This book is about finding out where you stand.
