Excerpt: ... for that purpose, altho in fact there is a stagnation of business for about two months in the long vacation; the offices are then shut, and the suitors cannot proceed. The exchequer holds sittings, for equity business, out of term; at which also a matter relating to the revenue may be discussed. The number of judges in each court are, and usually have been, four; but five have sometimes been appointed; and under the usurpation of Cromwell', in the beginning of Trinity term 1655, justice Ask sate alone in the king's bench, then called the upper bench, being the only judge thereof, except a chief justice, then newly constituted, and who the fame day took his place accordingly. Eleven of the twelve judges are so made by patent, the chief justice of the king's bench, who is stiled chief justice of England, and d Vr Mad, hist. exch. c, 20. 4., where it is also said, this court may fit on Sundays. For this strange position one prece. dent only is vouched of a summons, in 11 H. III. for the Lord's day, in a revenue matter. If such practice really obtained, and 1 was under a necessity of accounting for it, I should attribute it partly to the maxim, that the king's rights were not to be delayed, and partly to the length of the sabbath, by the AngloSa'ion laws, including part of Saturday and Monday.
