Como resultado de las polÃticas arbitrarias que llevaron al colapso de Petróleos de Venezuela, S.A. (PDVSA), desde el año 2013 se implementaron nuevos contratos petroleros que gradualmente ampliaron el rol de la inversión privada, al margen de los cauces previstos en la Ley Orgánica de Hidrocarburos. A partir de 2018, estos contratos, bajo la modalidad de contratos de servicios petroleros, transfirieron a inversionistas privados actividades de producción que, por Ley, solo pueden estar a cargo de empresas operadoras, incluyendo empresas mixtas. La polÃtica de sanciones económica hacia Venezuela, adoptada por el Gobierno de Estados Unidos, creó incentivos para avanzar en estas fórmulas contractuales, con las medidas de flexibilización adoptadas mediante licencias generales e individuales entre 2022 y 2024. En este contexto, y al amparo de la inconstitucional Ley Anti-Bloqueo, surgió el modelo del contrato de participación productiva (CPP), que es la principal herramienta de la cual se vale PDVSA para promover el rol de la inversión privada en el sector, en un manto de opacidad. Este libro del Profesor José Ignacio Hernández G., detalla los orÃgenes y contenido de este contrato, tomando en cuenta la polÃtica de privatización de facto de la industria petrolera y las sanciones económicas, colocando especial énfasis en el rol de Chevron, como socio minoritario de empresas mixtas y contratista del CPP, rol reforzado con la licencia individual otorgada por el Gobierno de Estados Unidos a fines de julio de 2025.
