Desde esta premisa, Domingo Cuevas-Andújar desarrolla un marco conceptual sólido que explica por qué numerosas instituciones, aun contando con leyes, reglamentos, códigos de conducta y discursos éticos, fracasan de manera sistemática; y por qué otras, incluso bajo contextos adversos, logran gobernar con estabilidad, sancionar con legitimidad y sostener coherencia a lo largo del tiempo. El libro demuestra que la diferencia no radica en la calidad moral de las personas, sino en el diseño de incentivos, consecuencias y márgenes de discrecionalidad.
La obra introduce la TeorÃa del Orden Ético Institucional, una formulación que integra normas ejecutables, incentivos alineados, consecuencias ciertas y control de la discrecionalidad como variables estructurales del comportamiento institucional. Esta teorÃa se formaliza mediante una ecuación conceptual que permite diagnosticar fallos sistémicos, comparar instituciones y orientar intervenciones precisas. La ética deja asà de ser un concepto normativo difuso y se convierte en una variable analÃtica y operativa.
Como desarrollo práctico de esta teorÃa, el libro presenta el modelo DOCUAN, concebido como un sistema integral de diseño, medición e intervención institucional. DOCUAN articula herramientas para identificar riesgos estructurales, puntos de fallo recurrentes, zonas de impunidad y debilidades en los regÃmenes de consecuencias. A través de este modelo, la ética se transforma en acción operativa, capaz de traducirse en decisiones, procedimientos, controles y resultados medibles.
A lo largo de sus capÃtulos, la obra aborda de forma sistemática temas clave como la discrecionalidad no controlada, la impunidad estructural, la automatización sancionadora, la trazabilidad del poder, la transparencia estructural, la responsabilidad institucional y la resiliencia ética. Asimismo, se exploran mecanismos de alerta temprana, criterios de gobernanza avanzada y procesos de transición desde modelos reactivos hacia órdenes éticos estructurales y sostenibles.
Uno de los aportes más relevantes del libro es su enfoque aplicado. DOCUAN no se presenta como una teorÃa para ser admirada ni como un ejercicio meramente académico, sino como un modelo para decidir. Cada uno de sus componentes está diseñado para ser implementado, evaluado y ajustado en instituciones reales, tanto públicas como privadas, en distintos niveles de complejidad y desarrollo.
