Esta obra del profesor Allan R. Brewer-CarÃas, con Presentación por el profesor Gustavo Urdaneta Troconis, y textos A manera de Prólogo, de los profesores Carlos Ayala Corao y Rafael Badell Madrid, contiene una serie de estudios con Nuevas Reflexiones del autor sobre la democracia, que sigue siendo el tema prioritario en el momento actual de Venezuela, cuando se cumplen 215 años de su Independencia, particularmente luego de la terminación forzosa, a partir del 3 de enero de 2026, de la usurpación que presidÃa Nicolás Maduro, y que de la suplencia temporal de su ausencia forzosa por su Vicepresidenta, se convirtió en una falta absoluta que solo una elección presidencial libre, plural, confiable y verificable puede permitir restablecer la legitimidad del gobierno que necesita el paÃs, para poder restablecer un Estado que ha sido destruido durante los últimos 25 años, y atender la devastación trágica del terremoto del 24 de junio de 2026.
El libro reúne asÃ, diversas reflexiones recientes del autor, sobre el derecho a la democracia (para Salamanca y Bogotá; sobre el rol del juez constitucional en la destrucción del principio democrático representativo (reflexiones para Trujillo y Toledo); sobre el Estado de derecho y su desintegración bajo el régimen autoritario (reflexión para México); sobre los intentos de sustituir la democracia representativa por una supuesta democracia participativa (reflexión en Nueva York); sobre al soberanÃa popular, el republicanismo y la democracia en el inicio de la independencia (reflexión en Nueva York); sobre la reinstitucionalización del estado democrático de derecho y la necesaria depuración normativa. (reflexión para Caracas); sobre. los jueces ante el derecho y la democracia (reflexión para M0; y sobre la dictadura judicial, el law fare y la criminalización de la polÃtica (reflexión para Miam.). Y concluye con unase postscipta: sobre el decreto de estado de emergencia dictado con ocasión del terremoto del 24 de junio de 2026 y su lamentable e innecesaria inconstitucionalidad (reflexión en Nueva York), y sobre el término de la suplencia de la falta temporal o ausencia forzosa de Nicolás Maduro, y dada su falta absoluta a partir del 3 de julio de 2026, y la necesidad de una transición democrática (reflexión en Nueva York).
