Este libro del profesor Allan R. Brewer-CarÃas, con el tÃtulo de Justicia Constitucional y Jurisdicción Constitucional, es el Tomo XII de su Colección Tratado de Derecho Constitucional, en el cual se recogen, en 1.198 páginas, sus estudios sobre el tema general del control judicial de la constitucionalidad de los actos estatales, tal como fueron publicados en las últimas décadas. A tal efecto, los mismos se han agrupado en este volumen, en las siguientes partes:
En la Primera parte, se incluyen los estudios sobre los principios de la justicia constitucional, en particular los que se refieren a la supremacÃa constitucional como fundamento de la justicia constitucional y a ésta, como garantÃa de la Constitución; y a los diversos sistemas de justicia constitucional, y a su efectividad sujeta a la existencia de un Estado de derecho, en un régimen democrático donde exista un sistema de control del poder.
La Segunda parte recoge los diversos estudios del autor sobre el sistema de justicia constitucional tal como se estableció en la Constitución venezolana de 1999, con referencia a los diversos instrumentos de justicia constitucional (acción de inconstitucionalidad, controversia constitucional, protección constitucional frente a particulares) previstos en la misma; y a los procesos y procedimientos constitucionales ante la Jurisdicción Constitucional.
La Tercera parte de la obra, recoge en particular los estudios sobre el régimen legal de la Jurisdicción Constitucional tal como se reguló en la Ley Orgánica del Tribunal Supremo de Justicia (2010), con particular referencia a la competencia de la Sala Constitucional del Tribunal Supremo como Jurisdicción Constitucional; y a los diversos procesos y procedimientos constitucionales regulados en la Ley que se desarrollan ante dicha Jurisdicción constitucional.
En la Cuarta parte se recogen los estudios sobre la justicia constitucional y los procesos y procedimientos constitucionales, no solo desarrollados ante la Jurisdicción Constitucional (método concentrado de control), sino también los desarrollados ante la Jurisdicción Ordinaria mediante el ejercicio por los jueces ordinarios del método difuso de control de constitucionalidad; a través del proceso de amparo, y ante la Jurisdicción Contencioso Administrativa.
En la Quinta parte se recogen diversos estudios sobre aspectos especÃficos de la acción popular de inconstitucionalidad; sobre el objeto del control concentrado de la constitucionalidad (leyes y actos de ejecución directa e inmediata de la Constitución), sobre el recurso de interpretación abstracta de la Constitución, y sobre el control judicial de oficio en materia de justicia constitucional.
La Sexta parte recoge los estudios del autor de derecho comparado sobre la situación y progreso de la justicia constitucional en América Latina, incluyendo estudios especÃficos sobre aspectos de los sistemas de justicia constitucional en Panamá, Honduras, República Dominicana, Colombia y Perú.
La Séptima parte recoge, en particular, los diversos estudios sobre las sentencias constitucionales y la interpretación constitucional, con particular referencia a sus efectos vinculantes en Venezuela; y por último, en la Octava parte se recogen los estudios del autor sobre el control de convencionalidad, su conceptualización y su necesario deslinde respecto del control de constitucionalidad, con referencia especÃfica a los antecedentes de la protección del derecho convencional en el ámbito interno.
