Este libro del profesor Héctor Turuhpial Cariello, es un estudio completo y comparado sobre la gestión jurÃdico pública de las crisis bancarias en el derecho venezolano y en el derecho comparado, particular referencia al derecho comunitario europeo el cual ha desarrollado sistemas regulatorios globales, conformados en mucho por las directrices del Comité de Basilea, aplicables por igual a los distintos sistemas financieros nacionales, y caracterizados por una red de seguridad financiera que comprende un mecanismo único de supervisión, un mecanismo único de resolución y un fondo de auxilio de liquidez, liderados en su ejercicio por el Banco Central Europeo.
El estudio otorga un particular tratamiento a las causas cÃclicas de las crisis bancarias, recurriendo para tal análisis al estudio multidisciplinario de los presupuestos de riesgo, distinguiendo entre las causas endógena, las exógenas y las atribuibles netamente a los administradores bancarios y accionista de la institución bancaria. En ese sentido, se citan y explican minuciosamente los casos de fraude bancario más escandalosos de la última centuria y por supuesto la reseña de la crisis financiera mundial que comenzó en el año 2007 con las hipotecas sub-prime.
No dudamos que este libro que hoy presenta el profesor Turuhpial Cariello constituye un aporte original y valioso y será de suma utilidad para formarse una idea precisa y completa de cómo se enfrentan las crisis bancarias, tanto desde la posición de la autoridad supervisora, como desde el rol de accionista o administrador de la institución a la cual pretenda imponerse una medida o un mecanismo de resolución.
