Presentación (continuación)De tal suerte que logramos sistematizar 22 temas de Bienes y Derechos Reales a los fines de que el estudiante o el estudioso de la asignatura cuente con una sistematización básica de la materia. Como es natural, tal vez el reto más fuerte -común en el Derecho Civil- ha sido resumir una materia tan rica y tan amplia. Por lo que, ciertamente, todos los temas podrán ser ampliados y profundizados hasta llegar a monografías, como suele suceder en el Derecho Civil. Pero nuestro objetivo actual simplemente fue sistematizarlos a la luz de la bibliografía básica nacional y los estudios monográficos o especiales, para que los interesados puedan acceder a un conocimiento más complejo. También, dependiendo del tema, referimos algunas decisiones judiciales, las cuales son abundantes en algunos de ellos, en tanto que en otros son enteramente escasas.
Punto clave en nuestra investigación -que ha reconocido la coautora en otra oportunidad- son las clases de Enrique Lagrange, quien fue su profesor de Bienes y Derechos Reales en la Escuela de Derecho de la Facultad de Ciencias Jurídicas y Políticas de la Universidad Central de Venezuela durante 1990, y a cuya memoria dedicamos nuestro trabajo sobre el consensualismo. Por lo que, nuevamente, citamos extractos de sus didácticas y completas clases, por ser una forma de no perder su gran aporte a la materia. Y como tal, enriquecemos el presente estudio con sus ideas, que en esencia siguen vigentes a pesar las décadas transcurridas, gracias a sus claras y pedagógicas lecciones.
Explicaciones didácticas que son requeridas por el estudiante de Derecho Civil II, pues se alude a la no fácil pedagogía de los derechos reales o a que la materia de los derechos reales es verdaderamente árida y por ende, no fácil de ser enseñada de manera interesante. La materia, al parecer, se impone para algunos como especialmente densa dentro del área civil patrimonial. Ello precisa ubicar a los autores que más didácticamente expliquen la asignatura. Si bien igualmente afirma un autor patrio que en general en materia de bienes y derechos reales la doctrina es menguada, intentamos pasearnos por la misma y hacer breves referencias a aspectos actuales, como es el caso de los asociados al Derecho público considerados por la doctrina nacional especializada, así como a la doctrina extranjera, que ha dedicado especial interés en profundizar algunas instituciones, como la ocupación o la servidumbre, cuyo desarrollo local ha sido escaso.
También tratamos de no desplegar excesivo tiempo en complejas discusiones teóricas asociadas a la naturaleza jurídica de las instituciones, a la vez que buscamos algunos ejemplos derivados de la jurisprudencia que permitan contactar al lector con el lado práctico o vivo de la asignatura. Presentamos entonces el resultado de varios años de investigación, a la que nos dedicamos con la idea de su difusión libre y electrónica, dada la obvia escasez de ediciones impresas.
A lo largo del tiempo, siempre algunas personas nos inspiran en las cosas que hacemos. En el caso que nos ocupa, ellos son, entre otros tantos, además de la Editorial RVLJ, sin duda, los estudiantes con sus inquietudes, los colegas con sus conversaciones y nuestras familias por sufrir la dedicación que supone una investigación como la que felizmente hemos culminado. Esta última expresión mal puede entenderse en el sentido de que damos por terminado nuestro estudio, al contrario, el mismo nos luce como un acercamiento al Derecho Civil II. Esperemos poder seguir profundizando sobre tan rica materia, porque, así como nadie escapa de las relaciones de familia o de las relaciones obligatorias, todos y cada uno de nosotros -aunque nos sintamos pobres o carentes de importantes bienes materiales- estamos inmersos en relaciones reales, es decir, relativas a las cosas.
