El Tomo II de Capacidad para Comparecer en Juicio retoma el camino exactamente donde lo dejó el primer volumen, constituyendo su complemento indispensable e inseparable. Si el Tomo I sentó las bases históricas, jurÃdicas, neurobiológicas, metodológicas y psicopatológicas esenciales, este segundo volumen aplica todo ese andamiaje conceptual a los escenarios de mayor complejidad y exigencia de la práctica forense real. A lo largo de sus diez capÃtulos -del 11 al 20-, el lector encontrará el análisis en profundidad de los trastornos neurocognitivos (demencias y deterioro cognitivo), con criterios claros para la determinación de la incompetencia permanente e irreversible, asà como el estudio pormenorizado de los trastornos de la personalidad -lÃmite, antisocial, narcisista y paranoide- y el siempre espinoso problema de la simulación, para el que se ofrece un arsenal completo de técnicas clÃnicas y psicométricas de detección. Este bloque temático presupone el dominio de la psicopatologÃa esencial que el lector ya adquirió en el primer volumen, y le permite ahora enfrentarse a los casos más sutiles y desafiantes de la evaluación pericial.
Los capÃtulos centrales del Tomo II amplÃan el foco hacia la gestión procesal y las poblaciones vulnerables. Se analiza la competencia en procedimientos especiales -la confesión en sede policial, la autodefensa bajo el estándar Edwards, la participación en ruedas de reconocimiento, la extradición internacional o la ejecución de la pena capital-, y se dedica un capÃtulo completo a la restauración de la competencia, explorando los programas de psicoeducación legal, el uso de psicofármacos bajo el estándar Sell y el delicado dilema ético del paciente competente pero peligroso. Asimismo, se examinan las particularidades de la evaluación en poblaciones especiales -menores, ancianos, migrantes, vÃctimas de violencia de género y personas sordas-, siempre bajo el prisma de los ajustes razonables y el modelo social de la discapacidad que ya fue introducido en el Tomo I. Estas secciones dotan al perito de las herramientas necesarias para adaptar su evaluación a contextos procesales especÃficos y a las necesidades de los acusados más vulnerables.
La obra culmina con los capÃtulos dedicados a los productos finales de la labor pericial y a las perspectivas de futuro. El lector aprenderá el arte de elaborar el informe pericial escrito -desde su estructura formal hasta la integración de resultados psicométricos y la evitación de errores frecuentes- y se preparará para el testimonio en la vista oral, con técnicas para defender el dictamen frente al contrainterrogatorio hostil y para comunicar la ciencia psiquiátrica al juez y al jurado lego. Un capÃtulo Ãntegro aborda los dilemas éticos y legales que atraviesan toda la práctica forense -la doble lealtad, la confidencialidad, los conflictos de intereses, el cuidado del perito frente al estrés vicario-, y otro analiza casos emblemáticos -Kaczynski, Loughner, Ferguson- extrayendo lecciones perdurables de la jurisprudencia real. El volumen se cierra con una mirada prospectiva a las fronteras del futuro: telepsiquiatrÃa forense, inteligencia artificial aplicada al discurso, neuroimagen funcional, neuroética y el horizonte del metaverso judicial. En conjunto, el Tomo II no puede entenderse sin el primero, pero lo completa de manera imprescindible, convirtiendo la obra en el tratado de referencia definitivo en lengua española sobre la capacidad para comparecer en juicio.
