Este libro del profesor Alan R. Brewer-CarÃas sobre la actividad administrativa, la actividad de gobierno y el poder discrecional, recoge tres estudios escritos en diferentes épocas, con ocasión de Ponencias presentadas en Congresos y Jornadas jurÃdicas, siempre reelaborando el tema, en aproximaciones sucesivas, y que fueron publicados dispersamente en Revistas y Obras colectivas.
Trata por una parte de la actividad administrativa, que es el objeto esencial de regulación del derecho administrativo, es decir, la actividad que desarrollan los órganos y entes de la Administracion Pública, generalmente en ejercicio del Poder Ejecutivo del Estado y en la mayorÃa de los casos, en ejercicio de la función administrativa del mismo, al cumplir las competencias que el ordenamiento les asigna para gestionar el interés general en nombre de la colectividad, entrando asÃ, con ello, en relación con los particulares o administrados.
Esa actividad, en todo caso, está siempre sometida al derecho, es decir, al principio de la legalidad, de manera que el funcionario que la realiza siempre debe actuar en ejercicio de competencias preestablecidas que le son legalmente asignadas, asà se trate de los casos en los cuales la ley le deje al funcionario cierta libertad para actuar en lo que se considera como actividad discrecional; y como todas las actividades del Estado, está sometida a control judicial, en particular por los órganos de la Jurisdicción Contencioso Administrativa.
El estudio de dicha actividad administrativa, por lo demás, manifestada entre muchos otros, a través de la emisión de actos administrativos requiere, entre otros aspectos, de una delimitación precisa respecto de la otra actividad que realizan los órganos que ejercen el Poder Ejecutivo, que es la actividad de gobierno, y que se manifiesta a través de la emisión de actos de gobierno. La distinción entre una actuación y otra, como se destaca en estos estudios, contribuye, por una parte, a aislar adecuadamente la actividad administrativa, sometida al control judicial de la Jurisdicción Contencioso Administrativa; y por la otra, a identificar con precisión la acción de gobierno, fuera de la acción administrativa, pero no por ello está exenta de control judicial, que en ese caso le corresponde a la Jurisdicción Constitucional.
