Rights Are Not Permissions: Natural Rights, Delegated Power, and the Limits of Government asks a foundational question that modern political arguments often skip: Where do rights come from, and where does government get the authority to act?
If rights originate with government, then government remains above them. What government grants, it can redefine, restrict, ration, or withdraw. But if human beings possess rights before civil government exists, then government has a different role. It does not create those rights. It is entrusted with limited authority to recognize, protect, and preserve them.
Drawing on the natural-rights tradition, John Locke, Jonathan Mayhew, the American Founding, constitutional principles, Scripture, and other historical witnesses, Mark A. Wittenborn examines the hierarchy beneath debates about liberty, property, equality, consent, political power, and public responsibility. Historical sources are not treated as unquestionable authorities. They are used as witnesses whose arguments can be examined, tested, and carried into modern questions.
The book distinguishes liberty from license, arguing that freedom does not mean the absence of all restraint. Rights exist alongside duties, and no person's liberty grants authority to destroy the equal rights of another. Self-government therefore requires more than limiting government. It also requires citizens capable of governing themselves.
Property is examined not merely as possession or wealth, but as one of the places where independence becomes visible. Ownership, labor, stewardship, taxation, regulation, and the danger of converting ownership into continuing governmental permission are considered through the larger question of rightful authority.
A central principle runs throughout the book: rights come down; legitimate civil authority comes up. Human worth and natural rights are not created by elections. Civil institutions, however, receive delegated authority through lawful political arrangements. Legislatures, courts, executives, and agencies possess real authority, but none possesses all authority.
From that foundation, the book explores consent of the governed, majority rule, constitutional limits, government as trustee rather than owner, licensing and regulatory power, the public good, emergency authority, arbitrary power, and the citizen's responsibility within a Constitutional Republic.
Special attention is given to a simple consistency test: Would we still support a particular government power if it were placed in the hands of the political leader or party we trust least? A principle that survives only while our own side holds power is not functioning as a principle.
The later chapters examine why institutions matter. Constitutions, divided powers, due process, federalism, elections, courts, and other restraints are forms of accumulated memory. They preserve lessons learned from earlier abuses of power. When citizens remember the benefits of liberty but forget the reasons for its restraints, rights can remain on paper while slowly becoming permissions in practice.
This is not an argument against government. Government is necessary for justice, public order, defense, impartial judgment, and the protection of rights. It is also limited because the moral order it serves is older than the office and because every human authority is capable of abuse.
Rights Are Not Permissions is ultimately a book about formation: learning to ask better questions about power, responsibility, jurisdiction, precedent, and liberty-and then applying the same principles even when doing so costs us politically.
If we want to keep the fruit of liberty, we must understand and tend its roots.
