Excerpt: ... framed the law of 24th May, 1861, with those modifications accepted by the Government engineer, Mr. Alexander Babinski, in the plans and profile approved by the Supremo Government by decree of October 24, 1877, having in view the report of the central committee of engineers, the originals of which are in the archives of that office. Said tunnel shall pass, at the least, from fifty to sixty yards iraras) below the level of the actual tunnel of Quinlacocha, with all the laterals the company may deem useful. Art. 2. The tunnel shall be completed, at the latest, within two years after the railway may be opened to general traffic. These works being completed in accordance with the plants, should the company consider it advantageous to execute other supplemental works or ramificatious for the benefit of the general development of the mines, it shall have tho right to do so, provided, always, that the rights of third parties bo not prejudiced. Art.: i. During tho execution of this work the compauy shall enjoy all tho privileges which the mining laws grant to mining companies. Art. 4. Inasmuch as the fact of perforating the tunnel entitles the company to the enjoyment of all rights secured to prospectors by the mining ordinances, to it belong all the grounds not otherwise held in accordance with tho conditions of tho former contract. Tn respect to mines known and owned the company recognizes all the proprietary rights of the miners in all cases iu which the mines are properly entered in the Mining Register for the second half of the year 179 as having paid tho contribution; but in the case of thoso mines which have been or may be abandoned, or which may have remained or may remain liable to be denounced in the future from failure to pay the...
