Currently, we are seeing a trend toward providing investors with various legal guarantees and advantages to stimulate capital investment when concluding investment contracts with them. At the same time, an investment contract establishes both rights and obligations for both parties, which must be fulfilled and observed by both parties. Undoubtedly, an investment agreement is complex in structure and encompasses various types of legal relationships and obligations. However, it should be acknowledged that the legal relationships arising from investment agreements share common features that allow them to be grouped together. For example, under an investment contract, one party (the investor) undertakes to invest funds in the construction of a building or sports complex with the aim of subsequently generating a profit, or in the restoration of a cultural heritage site in order to obtain lease incentives for the relevant property (for example, under a concession agreement). The conclusions presented in this paper focus on the possibility of classifying such an obligation as an investment obligation, which should serve as a distinguishing feature of investment contracts.
