Article 65(8) of the law governing electronic communications, which provides that: Decisions of the body may be appealed (...) before the courts of general jurisdiction, lacks precision. It assigns appeals against decisions of the A.R.T. regarding the resolution of disputes to the courts of general jurisdiction. An interpretation of this article suggests that courts of general jurisdiction here refer to both the judicial and administrative courts. It does not expressly designate the competent courts within each branch. Upon analysis, it appears that appeals against the A.R.T.'s decisions may be brought either before the courts of the judicial branch or before those of the administrative branch, depending on the nature of the dispute in question. When the A.R.T. exercises its regulatory authority, the most appropriate court to hear appeals against its decisions is the Court of Appeals, since, with respect to this authority, the A.R.T. functions as a quasi-first-instance court. Conversely, appeals against administrative sanctions imposed by the A.R.T. must be filed with the administrative court.
