The debate about rationing in health services is an international one. Comparing medical benefits which can lead to rationing of health care is inherent in the German public health care system (GKV). Therefore the panel physician is not liable to prosecution. Additionally there is no prohibition of implicit rationing. From an ethical point of view it restricts an ideal medical treatment in favour of an optimal one for all statutorily insured patients.
