The survey explores to what extent interactions of merging undertakings are admissible under EU competition law during the waiting period provided by Article 7 ECMR. It takes into consideration the economic effects of such interactions and includes a comparative analysis of the case law in the US. The author argues for a narrow interpretation of the suspension obligation. Furthermore he analyzes the legal boundaries provided by the cartel prohibition and points out to what extent information exchange is admissible. For his research the author received the Jacques Lassier Prize of the International League of Competition Law.
