[Introduction to IPR; Art 3-6 EGBGB; Appendix to Art 4 EGBGB; Appendices I, II, III, IV to Art 5 EGBGB. International Private Law - General Part]
This volume contains the most comprehensive, legally comparative portrayal of international private law in general and according to Articles 3 - 6 of the EGBGB in particular. The introduction explains the methods and models of the international private law and gives - in the form of a legally comparative base -an overview of the valid law of conflict, whereby the emphasis is based on the sources of EU States. The commentary to Article 3 EGBGB primarily considers the important priority of the individual statute over the total statute in the area of matrimonial property law and the law of inheritance, which can lead to a special situation of real estate owned abroad, if this is subject to special regulations law in the location state. A point of emphasis of the commentary is placed on dealing with the cross-referencing and further instructions to be observed in property law in Article 4 EGBGB (the central norm of German international private law) which has to be taken into account by the German courts both in international law of persons, family and inheritance law and also in the non-contractual law obligations, . In a more than 250 page comprehensive Appendix to Article 4 EGBG, an overview of the law of conflict in the most important countries in the fields of the law of persons, family and inheritance law is given as are indications of the practical consequences which arise for the individual applying German law in view of possible cross-references or further instructions. Therefore the current status of numerous reforms of international private law which have been concluded in numerous countries, in particular in the states born from the former Soviet Union, are considered. The revised edition of Article 5 EGBGB looks in particular at the implications of the nationality reform and devotes itself in a separate section to the question of admissibility in community law of international private law negotiations according to the nationality principle. The commentary of Article 6 EGBGB clarifies the purpose of the standard, the function and the handling of the general exceptions clause in German international private law.
