Der vorliegende Band Familienrecht veröffentlicht
erstmals das nachgelassene Manuskript des gro en germanistischen Rechtsgelehrten Otto
von Gierke (1841-1921). Das Familienrecht war als IV. Band seines bedeutenden
Werkes Deutsches Privatrecht geplant, dessen erste drei Bände Allgemeiner Teil
nebst Personenrecht , Sachenrecht und Recht der Schuldverhältnisse in den Jahren
1895, 1905 und 1917 erschienen waren. Gierkes Tod hat die Beendigung des IV. Bandes
verhindert. Fertiggestellt war aber ein immerhin fast 900 Blatt umfassendes
Manuskript, das mit Ausnahme des Rechts der Vormundschaft und der Pflegschaft das
gesamte Familienrecht behandelt, also Eherecht und Ehegüterrecht, Verwandschaftsrecht
und die Rechtsverhältnisse zwischen Eltern und Kindern.
Die hohe Anerkennung, die den erschienenen Bänden des Deutschen Privatrechts als
Summe der deutschen Privatrechtsdogmatik des 19. Jh. zuteil geworden ist, darf in
gleicher Weise der Band Familienrecht für sich beanspruchen. Gleicherma en wie
bereits im II. Band tritt auch hier Gierkes Anliegen, das BGB im Licht
deutschrechtlicher Traditionen darzustellen, deutlich hervor. Zudem dürfte der Band
Familienrecht neue Anstö e zur wissenschaftsgeschichtlichen Würdigung Gierkes
geben, hat Gierke doch stets auch Ehe und Familie als Ausformung des
deutschrechtlichen Genossenschaftsgedankens proklamiert. Eine reiche Fundgrube stellt
der Band aber auch für die Geschichte des Familienrechts selbst dar. Die Fülle des in
Form gebrachten und dogmatisch durchleuchteten Stoffes nötigt nach wie vor
Bewunderung ab. Erwähnt sei hier nur die breite Berücksichtigung der nahezu
unabsehbaren deutschen Partikulargesetzgebung des 19. Jh., die selbstverständliche
rechtsvergleichende Einbeziehung der europäischen Kodifikationen und vor allem: eine
an Detailfülle und Genauigkeit wohl unerreichte Gesamtdarstellung des Familienrechts
in den ersten 20 Jahren des BGB.
