Dans sa détermination à faire régner l'ordre, le législateur a entendu élargir le champ des incriminations en atteignant non seulement les comportements délictueux classiques mais également d'autres catégories d'actes. Parmi ces comportements reprouvés figurent ceux qui perturbent l'ordre politique, soit l'infraction politique.
Les infractions politiques sont celles qui menacent le régime ou les institutions politiques du pays .
Certes, les infractions politiques sont assez difficile à qualifier. Ce qui amène dans la pratique à la prise en considération des distinctions doctrinales. La loi n'ayant pas donné une définition quelconque, la qualification politique de l'acte est soit déterminée suivant la peine prévue, soit déduite de sa proximité dans le Code pénal avec les crimes politiques ou de sa connexité avec une infraction politique. Le monde a connu cette criminalité il y a fort longtemps depuis que les hommes ont décidé d'avoir une vie collective et organisée. En 1830, la France a déjà distingué les infractions politiques de celles de droit commun .
Actuellement la notion d'infraction politique n'a pas fait une avancée quant à la clarification de ses contours, ce qui engendre une confusion généralisée. Or, face aux événements politiques successifs qui chamboulent la société, l'infraction politique attire l'attention de tout un chacun et mérite donc d'être approfondie. Et ce afin d'éviter sa confusion à l'infraction ordinaire notamment commise par les dirigeants politiques dans le cadre de leur fonction.
La conception de cette infraction n'est pas unitaire. Aucune définition généralement admise n'est prévue universellement en raison de la variation de la définition même de la politique.
La conception diffère selon le régime politique d'un pays. Comme dans un État autoritaire, elle est traitée avec rigueur puisque toute idéologie contraire à celle du pouvoir politique en place est considérée comme un acte lésant l'ordre politique. Par ailleurs, dans ce régime, le délit d'opinion est créé pour cette cause. En revanche, la loi lui est favorable dans un État libéral par le pluralisme d'idéologie qui tolère une cause noble du délit politique en le soumettant à un régime de faveur.
