Le 15 février 2013, un père monte sur une grue du port de Nantes pour réclamer le droit de revoir son fils. Il y passe quatre jours. Le lendemain, un second père escalade la grue voisine. Dans les mois qui suivent, d'autres hommes occupent des cathédrales, des châteaux d'eau, des ponts, dans toute la France, avec la même revendication: voir leurs enfants.
La France a réagi en quarante-huit heures. Une qualification s'est imposée, relayée partout, et le débat s'est refermé. Quatorze ans plus tard, personne n'a jamais lu le corpus de ce que ces pères demandaient vraiment sur leurs banderoles.
Ce livre le fait, ligne par ligne. Et le résultat surprend: ces hommes ne réclamaient ni de l'argent, ni une réduction de pension alimentaire, ni la garde exclusive. Ils demandaient à préparer les repas, à laver du linge, à emmener leurs enfants à l'école, à les coucher le soir. Ils réclamaient la charge quotidienne, celle que l'étiquette qu'on leur a collée aurait dû leur faire fuir.
À partir de ce constat, l'enquête déplie tout le dossier français de la résidence des enfants après séparation. Que disent réellement les chiffres du ministère de la Justice sur la garde alternée et la résidence alternée ? Pourquoi la France plafonne-t-elle à douze pour cent d'enfants en alternance quand soixante-seize pour cent des Français y sont favorables ? Que devient une demande de résidence alternée formulée par un père quand la mère s'y oppose ? Pourquoi l'État a-t-il cessé de publier ces statistiques après 2013 ?
Le livre examine les six critères de l'article 373-2-11 du code civil et met au jour la mécanique du droit de la famille: un dispositif fondé sur la continuité, qui reconduit par construction la répartition existante, et un critère de conflit parental qui confère au parent opposé à l'alternance un pouvoir de blocage. Il compare la loi française à la loi belge de 2006, qui impose au juge d'examiner l'hébergement égalitaire en priorité. Il passe au crible les trois arguments biologiques ordinairement avancés pour justifier que le soin serait maternel, en s'appuyant sur les travaux de neurosciences les plus récents sur le cerveau des pères.
On y suit aussi le sort des propositions de loi sur la garde alternée, déposées et abandonnées les unes après les autres depuis 2013, et l'on découvre la phrase unique, produite par un organisme consultatif en novembre 2017, qui organise depuis huit ans la position du gouvernement français sur le droit de visite et d'hébergement. Ni plaidoyer, ni réquisitoire. Une enquête factuelle, sourcée, qui distingue à chaque page ce que les données établissent de ce qu'elles ne permettent pas d'établir. Un livre pour les pères séparés de leurs enfants, pour les mères confrontées à un conflit de garde, pour les avocats, les magistrats, les travailleurs sociaux, et pour quiconque veut comprendre comment la justice familiale française décide vraiment. Parce qu'avant de juger un homme perché à quarante-trois mètres, il faudrait au moins avoir lu ce qu'il a écrit sur son drap.Also in
