An assignment not identifying an application was filed for record together with an affidavit and two letters setting forth that the assignment was intended to apply to a specific application, and it was requested that the assignment be so applied; Held that there is no authority for recording in this Office the affidavit and letters and that it has been the uniform practice of the Office to refuse to record such papers, and as the assignment does not identify the application it cannot be applied thereto. In The Matter of the petition of George A. Haines that an affidavit and letters accompanying an assignment be recorded. Duell, Commissioner: This is a petition praying that a certain assignment and accompanying papers be admitted to record and that the said assignment be applied to application Serial No. 730,196, filed September 11, 1899, by Elmer A. Sperry. The assignment referred to sets forth that Sperry has transferred to George A. Haines--a one-half interest in and right to the said invention, as fully set forth and described in the specification prepared and executed by me on the first day of February, 1899, preparatory to obtaining Letters Patent of the United States therefor; and I do hereby authorize and request the Commissioner of Patents to issue the said Letters Patent to (ieorge A. Haines as the assignee of a one-half right, title, and interest in and to the same, for the sole use and behoof of the said George A. Haines and his legal representatives.
