Not illustrated.1904 Excerpt: ... Art. 2809. In the purchase of expectations the risks of the thing shall always be on the account of the purchaser. Art. 2810. The other rights and obligations, of the parties in the purchase of expectations, shall be those which are contained in the title of purchase and sale. TITLE XVIII. Of purchase and sale. CHAPTER I. General Provisions. Art. 2811. A purchase and sale is a contract by which one of the contracting parties obligates himself to transfer a right, or to deliver a thing, and the other to pay a fixed price in money. Art. 2812. If the price of the thing sold has to be paid partly in money and partly with the value of another thing, the contract will be one of sale when the part in money is equal or greater than that which is paid with the value of another thing; if the part in money should be less, the contract will be by way of exchange. Art. 2813. The contracting parties may agree that the price shall be that which is the current one of the day, or of a determined place, or that which a third party shall fix. Art. 2814. The price having been fixeed by a third party, it cannot be rejected by the contracting parties, unless by common consent. Art. 2815. If the third party does not wish to, or cannot, designate the price, the contract shall be without effect, exccept there be an agreement to the contrary. Art. 2816. The price of fruits or cereals sold on credit to persons not merchants for their consumption, cannot exceed the highest which those kinds shall have in the place in the period running from the time of the delivery to the end of the following crop.
