This work aims to establish a connection between three fundamental elements in linking the subject matter of the case to the notion of causality: the subject matter of the case as the subject matter of life, as advocated by Carnellutti. The lawsuit as an expression derived from life itself, and obligation as a process. Nothing that is constructed is necessarily immutable. Thus, everything is a construction that can change along the way (filing, development, and execution). Aristotle illustrates this very well by defining causality as four causes or motivations behind any act or omission: the material fact that serves as its basis; what it is, in terms of its structure of values; whom it follows; and for what purpose.
