In this bold and meticulously reasoned work, Dr. Larry S. Milner - physician, attorney, historian, and founder of The Society for the Prevention of Infanticide - issues a powerful call to restore the integrity of the U.S. Constitution and safeguard American democracy from religious control.
Drawing on his expertise in medicine, law, and history, Dr. Milner proposes a Twenty-Eighth Amendment to enshrine in the Constitution a woman's right to terminate an unwanted, nonviable pregnancy - a right previously recognized in Roe v. Wade and Casey but overturned in Dobbs v. Jackson Women's Health Organization. With clarity and conviction, he argues that the Supreme Court's 2022 decision replaced constitutional interpretation with religious doctrine, contradicting the Founding Fathers' intent to separate Church and State.
Through an engaging blend of historical narrative and constitutional analysis, Milner revisits the debates of the 1787 Constitutional Convention, traces the evolution of American common law on quickening, and demonstrates how the nation's amendment process ensures that sovereignty ultimately lies with the people - not appointed officials or clerical authority.
This book is both a constitutional study and a moral appeal. It re-examines the meaning of personhood, confronts the misuse of religious belief in public policy, and offers a clear, practical solution for reconciling women's rights, medical reality, and democratic principles.
Inside you'll find:
- An original proposal for a 28th Amendment guaranteeing reproductive liberty
- A historical comparison of Roe v. Wade, Casey, and Dobbs decisions
- Insightful discussion of Republic vs. Democracy in America's founding
- A defense of the separation of Church and State as vital to constitutional justice
