An Act To amend sections five and twenty-one of act number ninety-seven, of the Session Laws of eighteen hundred and seventy-nine, as amended, being section six thousand five hundred and thirty-nine and six thousand five hundred and fifty-five of Howell's Annotated Statutes of Michigan of eighteen hundred and eighty-two, relative to filling vacancies in the Superior Court of Detroit. ( 118.) Section 1. The People of the State of Michigan enact, That sections five and twenty-one of act number ninetyseven of the session laws of eighteen hundred and seventy-nine, as amended, being sections six thousand five hundred and thirty-nine and six thousand five hundred and fifty-five of Howell's Annotated Statutes of Michigan, of eighteen hundred and eighty-two, be and the same are hereby amended so as to read as follows: ( 119.) Sue. 5. In case of the absence from the city of Recorder or Circuit the Judge of said Court, inability to attend, incapacity to try act a .i ri Judge of any cause pending in said Court, or a vacancy in las office, the Superior Recorder of said city or any Judge of the Circuit Court for the whenthird judicial circuit, in which the City of Detroit is situated, may act as Judge of said Court, and as such Judge shall have and exercise all the powers and duties of the Judge of said Court until he shall resume his office, or such vacancy be filled.
