The book looks at the socio-political circumstances surrounding the establishment of the 1791 Amendments to the U.S. Constitution, known as the Bill of Rights, notably the Second Amendment addressing the Right to Bear Arms.
A critical element of the origin of the Second Amendment was the deliberated actions of the U.S. Congress to prevent the establishment of a substantial armed force that could potentially be used by the executive branch to intimidate Congress. Instead, the Congress wanted to continue the on-call civilian militia established by the British during its colonial rule. The difference between a standing army and the militia is that the former could be manipulated at the federal level while the latter retained state control of its militia force--with the provision that it could be federalized with state approval during time of national crises.
This system sufficed during America's major conflicts, including the War of 1812, the Mexican War, U.S. Civil War, and the Spanish-American War. However, the U.S. participation in the First World War exposed the weakness of the Volunteer/Militia system leading to the establishment of a sufficient standing military force and a major reorganization of the state militias into the National Guard. These changes, along with the advancement in firearms, begged the question of the need for a well-armed civilian force that could be called-up in national emergencies. Also complicating this issue was the potential abuse of the National Guard in civilian disputes including during workers' unrest and strikes and in civil rights confrontations. Another factor was the mass production of, and promotion of, firearms sales to the public making America one of the leading manufacturers of firearms, notably military-type assault weapons with substantial firepower. This phenomenon led to high homicide and suicide rates, many that could have been prevented or minimized. This dilemma is currently being played out in both the social and political arena in the United States.
